SUMAR PARA SANAR FUNDRAISING PLATFORM

TERMS AND CONDITIONS OF USE

“Sumar para sanar” platform – CIREC Foundation

  1. Identification of the operator

The “Sumar para sanar” platform is operated by Fundación CIREC – Centro Integral de Rehabilitación Colombia, a non-profit organisation domiciled in Colombia, tax ID (NIT) 860.066.767-4 (hereinafter, “the Foundation”).

Accessing and using the platform implies full acceptance of these Terms and Conditions.

  1. Nature of the platform

“Sumar para sanar” is an institutional awareness and fundraising channel that allows the Foundation to:

  • receive applications from people with disabilities or their representatives,
  • to assess and prioritise cases according to technical and social criteria,
  • manage fundraising campaigns to support health, rehabilitation, assistive devices, adaptive sport, livelihoods and entrepreneurship.

The platform is not a marketplace, is not a financial intermediary, and does not guarantee care, fundraising or specific outcomes.

  1. Case applications

Submitting a case through the platform:

  • constitutes a request for assessment,
  • does not guarantee approval, support, publication or funds raised,
  • is subject to review and decision by the Foundation in accordance with its internal policies.

The Foundation may request additional information to complete its assessment.

  1. Institutional assessment and decision

All submitted cases may be:

  • approved for institutional care,
  • approved for publication on the platform,
  • prioritised or placed on a waiting list,
  • directed to other pathways,
  • or declared ineligible.

Decisions are technical, collegiate and non-discretionary.

  1. Publication of campaigns

Only expressly approved cases may be published as active campaigns.

The Foundation reserves the right to:

  • determine when a campaign is published,
  • limit the number of active campaigns,
  • set the duration of each campaign,
  • to withdraw or close campaigns in accordance with these terms.
  1. Setting fundraising goals

The fundraising goal:

  • is set exclusively by the Foundation,
  • is based on technical, clinical and operational criteria,
  • corresponds to the cost of the support, service or programme to be delivered.

The beneficiary may not unilaterally change or set the goal.

  1. Management and allocation of funds

All funds raised through the platform:

  • are donations made to the Foundation,
  • do not belong to the beneficiary,
  • are not handed over in cash; the user understands that the money does not belong to them, that the organisation is the one that uses the funds, and that this is stated in advance.
  • are managed and used by the Foundation in accordance with its corporate purpose.

The Foundation may achieve efficiencies in managing the funds, without this implying any refund or automatic adjustment of the published goal.

  1. Full, partial or unmet fundraising target

The Foundation does not guarantee that campaigns will reach their goal.

Where funds are raised:

  1. a) Target fully met

The Foundation will deliver the support as defined.

  1. b) Target partially met

Depending on the type of support, the Foundation may:

  • deliver the support in full or in part,
  • prioritise the components with greatest impact,
  • supplement funds with partners,
  • reschedule delivery within reasonable timeframes.

For livelihoods support (rent, education, transport), support may be delivered partially (for example, for one or more months), provided a defined minimum deliverable amount is reached.

For entrepreneurship support, delivery will depend on reaching a minimum viable amount.

  1. c) Target not met

The campaign will be closed and removed from the platform, and the case will follow the institutional route defined by the Foundation, with no obligation to refund the beneficiary directly. The funds will be allocated to supporting other people with disabilities.

  1. Campaign duration and closure

Campaigns will run for a limited period, set by the Foundation.

Campaigns published on the “Sumar para sanar” platform will run for a limited, defined period, which will be stated in each case at the time of publication.

The standard campaign duration is sixty (60) days, with the exceptional possibility of extension up to a maximum of ninety (90) days, according to technical and operational criteria set by the Foundation.

Under no circumstances will campaigns remain active indefinitely.

Management after campaign closure

If a campaign does not reach its full fundraising goal, the Foundation will have a maximum period of up to twelve (12) months from the campaign closing date to:

– deliver the support in full or in part,

– supplement funds with partners or institutional resources,

– prioritise interventions within its social impact programmes, or

– reschedule delivery according to technical and social criteria.

Definitive closure of the case

If, once the maximum twelve (12) month period has elapsed, it is not possible to deliver the planned support in full or in part, the Foundation may declare the case definitively closed as a fundraising process, without this implying any obligation to refund the funds directly to the beneficiary.

The beneficiary's continuity in other institutional programmes will not be automatic and will depend on availability and the prioritisation criteria set by the Foundation.

  1. Early support

The Foundation may begin institutional care before, during or after a fundraising process, particularly in cases of urgency or continuity of care.

Early care:

  • does not guarantee subsequent fundraising,
  • does not commit the Foundation to delivering the support in full.
  1. Communication and updates

The Foundation may communicate progress, results and campaign closures through:

  • the platform,
  • email,
  • institutional channels.

Published information is for information purposes only and is not contractual.

  1. Use of content

Content published on the platform (texts, images, videos) is for institutional use and may not be reused without the Foundation's express authorisation.

  1. User responsibilities

The user undertakes to:

  • to provide truthful and up-to-date information,
  • act in good faith,
  • respect the social purpose of the platform.

Providing false information may lead to the case being closed.

Territorial scope

The “Sumar para sanar” platform is intended exclusively for people permanently resident in the Republic of Colombia.

For assessment and eligibility purposes, CIREC Foundation may request information verifying continuous residence in the country, except in exceptional cases duly justified and approved by the Foundation.

Extraordinary circumstances – Death of the beneficiary

In the event of the beneficiary's death during a campaign or during delivery, CIREC Foundation may close the case as an individual campaign.

Any funds raised but not yet used will be allocated to other social impact programmes and processes managed by the Foundation, in line with its institutional mission.

Substantial change in the beneficiary's circumstances

If, during a campaign or the care process, the beneficiary permanently moves their residence outside Colombian territory, or circumstances arise that make delivery of the support unfeasible, CIREC Foundation may close the case as an individual campaign.

In such cases, any funds raised but not yet used will be allocated to other social impact processes of the Foundation, in accordance with its institutional policies.

  1. Modificaciones

The Foundation may amend these Terms and Conditions when necessary. Updated versions will be published on the platform.

  1. Applicable law

These Terms and Conditions are governed by the laws of the Republic of Colombia.
